Member of Parliament for Wa Central, Hon. Dr. Rashid Pelpuo has reacted to recent news making waves that one Accra based business man, Seth Yeboah, has taken the MP for Assin North Constituency and the Clerk to Parliament to court over the election of Alban Sumana Kingsford Bagbin as the Speaker of the 8th Parliament of the 4th Republic.
According to the Lawmaker, Mr. Seth Yeboah “is on a wild fishing expedition to test the law Lord’s resolve to do the right by throwing the so called writ out of the window of the court with the rightful contempt it deserves.”
Below is why Dr. Rashid Pelpuo thinks the suit would be a complete failure;
1. Hon James Quayson never received any writ prior to coming into the chamber to be duly sworn in to represent his people who voted him as a Member of parliament. Though it has come out that the Clerk himself was not properly served what he did was to attempt to serve Hon Quayson’ on the floor of parliament. This is contrary to our rules and our laws. In any case Hon Quayson was not an MP and could not have been served by the Clerk as if he was a member of the House.
2. Given that the most outrageous decision is taken to take away Hon Quayson’s vote, Rt Hon Alban Bagbin would still have won with 137 votes for NDC to 136 for NPP.
He went further to state that “if we were in a banana Republic with the unlikely supposition that the writ succeeds, … the swearing in of parliament was illegal. MPs will not be Legitimate. The swearing in of the President was illegal. There was no Parliament and the President will not be legitimate plus the challenge of his legitimacy in court.”
